Privacy Class Action Dismissed Under Spokeo

As we recently touched on at the KMK Cybersecurity Seminar, lower courts are beginning to apply Spokeo Inc. v. Robins as defendants renew challenges to class certification.  On Friday, June 17, 2016, a U.S. District Judge in Wisconsin, applying Spokeo’s standing analysis, dismissed a putative class action for failure to allege a concrete harm, even though the complaint sufficiently alleged a particularized injury.  Access this decision at: 2016 U S Dist LEXIS 79820.pdf.
